The structural self-restraint of the Judiciary Power. Legitimacy, capacity and Theme 698 of the STF

Initially, we intend to discuss the theories behind the objective parameters for the intervention of the Judiciary in public policies in the decision of the Federal Supreme Court when the judgment of RE 684.612 (Topic 698). The text begins with brief comments on the input legitimacy of the Judiciary (democratic legitimacy and constitutional legitimacy), and then addresses its external output legitimacy (theory of institutional capacities) and its consequences. Finally, the structural decision theory is addressed. It is argued, at the end of the article, that there is a logical correlation between the theory of structural decision and the theory of institutional capacities – reason enough to believe in a “structural self-restraint” of the Judiciary. The Federal Supreme Court shows no signs of timidity regarding the possibilities of intervention by the Judiciary, as it considers that this branch of power is legitimately exercising its attributions as guardian of the constitution. The same argument cannot be said, however, regarding the form of his intervention. It is argued that the adoption of the structural process and the structural decision as language of the Judiciary is a recognition (explicit or implicit) of the lack of institutional capacity to materialize fundamental rights in a systemic way. Hence the reason to believe in structural self-restraint on the part of the Judiciary in these cases. Because it is a descriptive and exploratory study, it is carried out based on bibliographical and documental research, sometimes using the deductive method and, at other times, the inductive method, mainly in the criticisms and reflections about the doctrine, studies and normative texts.
