Abstract

In 2019, regulatory impact assessment (RIA) became a mandatory requirement in decision-making process of regulatory agencies and other bodies of the Brazilian Federal Public Administration. This has renewed the debate about RIA in the legal literature, justifying a deeper analysis on how RIA has been conducted in agencies where the practice is already well established. This paper analyses the Brazilian National Electricity Regulatory Agency (Aneel)’s RIA policy to answer the question of whether RIA reflects qualitative benefits to the agency's performance or represents only a formal and bureaucratic step in its decision-making process. To this end, the paper presents the results of an empirical research on the documents related to the process of development and implementation of the RIA policy at Aneel, as well as on the RIA reports produced by the agency since the policy came into force until 2020. These reports are analyzed according to two criteria: the use of empirical evidence to describe the problem addressed in the report and the consideration of regulatory alternatives. Based on this analysis, the paper discusses what are the results of Aneel's RIA policy so far and what are the challenges for its improvement.
