The present paper expatiates about the doctrinal e jurisprudential debates regarding the (im)possibility of the Brazilian Superior Court to carry out incidental control of constitutionality on special appeal in order to apply the law at the case, assigning translative effect to the appeal and considering examination about the (un)constitutionality of the legal parameter of control raised by the appellant as matter of public order without usurping the jurisdiction of the Brazilian Supreme Court.
