Abstract

This text deals with the proper fulfillment of the social function of the custodial sentence as an instrument of great social relevance, relating to the possible innovations focused on the Brazilian prison institutions. Finally, we present the problems and consequences of the current Brazilian prison system and the custodial sentence, and finally propose suggestions for improvement in this important criminal area.
