Abstract

The work intends to analyze the role of the State Attorneys for the effectiveness of the democratic regime and the guarantee of its good execution through the horizontal accountability network of the Brazilian State. Democracy is a system of government in which sovereignty originates with the people, represented by an elected political body. Despite the importance of voting and political representation, other elements are necessary for the institution of a high-quality democracy, such as transparency, the rule of law, and the theme of this work, a strong and well-defined accountability network through institutions that guarantee mutual institutional control by avoiding the arbitration of the State. The State Attorneys’ function is to represent the State before the Judiciary in addition to providing legal advice, and in performing such roles, they help in the execution, development and protection of democratic rights. Thus, this study aims to analyze how the State Attorneys General have acted to guarantee the Democratic Rule of Law as part of the Accountability Network. Therefore, an interdisciplinary qualitative research was carried out in books in the areas of Law and Political Sociology, in order to understand how Democracy has been protected by this body. The result found demonstrates that the Attorneys’ Offices, in addition to acting as an organ of judicial and extrajudicial defense of the member states, also act constantly for the defense and continuity of Brazilian democracy.
