The objective of this article is to analyze the characteristics of the right to forgetfulness and its application by the Superior Court of Justice in the judgment of the resources REsp n. 1.334.097-RJ and REsp. n. 1.335.153-RJ. The right to forgetfulness is an unfolding of the constitutionally consecrated rights to private life and intimacy. Thus, the individual has the right not to be constantly reminded of past events that no longer fit his current personal identity.
