Data protection has been an autonomous right in Europe since the 2000s, and the implementation of an authority to enforce the law has been underway since the 1970s on the Old Continent. In Brazil, the General Data Protection Law already faces some controversies, such as the one concerning the National Data Protection Authority, which, until now, has a transitory legal nature. The purpose of this paper is to discuss the concept of privacy, and finally, the importance of the independent character that should be given to the Brazilian National Data Protection Authority.
