This paper explores the legal reasons around charging for exclusive use of public goods by public service providers, specifically the use of state’s highway lands by electric energy providers. After considerations about the public goods exploration, will be analyzed the legal reasons that leds the higher courts to decide for impossiblity of charge, and then a critical analysis will be done with support of literature about the subject.
