The purpose of this article is to analyze the uncertainties that permeate the contracting made by state-owned companies, regarding the decisions of the control bodies when analyzing the legality of these contracts, focusing on the processes required for the choosing of the private partner and the criteria that should be observed by the state in regard to the price proposed by the private partner.
