Abstract

This article will aim to outline the fundamentals that led to legislative selection or discriminatory treatment between men and women, in the granting of retirement under the General Social Security. It will also seek to investigate whether legislative reasons remain in the current social context and whether the transsexual insured person presents the fundamentals that lead to discrimination.

The Study, finally, will try to point out what would be the possible solutions for the lack of normativity on the topic that proves to be extremely relevant for the whole society, in a way it can prevent fraud in the social security operational system and protect these minorities rights.
