Arbitration and mediation in bankruptcy

This article aims to analyze the compatibility of arbitration and mediation with situations involving insolvency or economic and financial crisis of companies. To this end, the explanatory methodology was adopted, with the aid of the technique of analyzing international and national documents and data. As will be demonstrated, both arbitration and mediation bring several possibilities that allow them to be incorporated into the bankruptcy law system, collaborating to reduce litigation by expanding access to forms of conflict resolution.
