This paper aims to carry out a broad analysis of the legal regulation brought by Chapter IV of the Brazilian General Data Protection Law (LGPD), which concerns the processing of data by Public Authorities. Along with the appointment of the subjects that will raise some of the most important discussions concerning this matter, the main purpose of this paper is to point out the most substantial omissions, contradiction, mistakes, confusions, and structural inconsistencies identified in the mentioned Chapter IV, which does not have a correspondent regulation in the European GDPR. In addition, the authors will present suggestions which – from their point of view – could lead to a better interpretation of some of the controversial legal dispositions.
