O Estado Administrativo no Brasil: um transplante jurídico imperfeito

O presente artigo tem por objetivo apresentar ao leitor brasileiro as discussões existentes na academia estadunidense acerca da legitimidade do estado administrativo e analisar em que medida elas podem ser transplantadas para o ordenamento jurídico nacional. Após a apresentação de argumentos contrários e favoráveis ao estado administrativo norte-americano, debate-se por que a discussão não se amolda de maneira exata à realidade brasileira, com ênfase na tradição de civil law do sistema jurídico brasileiro, bem como no caráter analítico e no elevado teor de emendas da Constituição de 1988. Em seguida, analisa-se como a discussão estadunidense sobre o administrative state pode ser útil a acadêmicos pátrios, apontando-se três possíveis direções para pesquisas no contexto brasileiro: discussões sobre o poder normativo da administração pública, sobre a ascensão de órgãos autônomos e suas implicações para a teoria da separação de poderes e, principalmente, sobre a legitimidade democrática de corpos burocráticos não eleitos. O artigo adota como metodologia a análise qualitativa e a revisão crítica da bibliografia estadunidense sobre o estado administrativo.
